5 diseases that give stability and prevent workers from being fired – Journal Contable

Not everyone knows, but there are some diseases that can guarantee job stability. These diseases, in turn, are directly related to work or work diseases.

According to Brazilian laws, job stability is temporary, however, it is still an important right that provides some safety for the worker to enjoy this time.

To better understand how the right to settling due to occupational or work-related illness works, let’s really understand what it means and what illnesses allow the settling period to be reached.

Differences between occupational illness and work

According to Law 8.213/91, occupational disease, also known as occupational disease, is caused by exercising a job as a worker.

The same Law 8213/91 also governs occupational disease, as this disease, unlike occupational disease, is not directly related to the job performed by the worker, but is related to the work environment.

Thus, the difference between occupational disease and work-related illness lies in the source of the disease. Seems a little baffling, doesn’t it? But let me explain this issue a little better.

  • occupational disease – related to the work itself, its peculiarities to the activity performed;
  • occupational disease – Related to the conditions of the work environment.

Diseases that give the right to settle at work

In 2020, the Ministry of Health provided an update to the list of diseases that can lead to workers’ settling.

As stipulated in Order No. 2,309, it is the diseases that appear in the list of work-related diseases, which are considered occupational, that are likely to generate stability.

The list of diseases that can lead to job stability is vast, however, here we will show the most common diseases that can generate a period of job stability.

Repetitive stress injury (RSI)

RSI refers to diseases whose main symptom is pain in the upper extremities, which leads to difficulty in movement and reduced range. This is one of the main reasons that lead to the dismissal of the worker.

Psychological and mental disorders

Anxiety, depression, panic syndrome, and burnout are illnesses that arise due to stress in the work environment and can lead to workers leaving until they recover properly.

Work-related musculoskeletal disorders (WRMD)

Improper posture, and excessive repetitive motions, can lead to chronic pain that results in a musculoskeletal disorder called Dort.

hearing loss

Usually, workers exposed to noise may experience temporary or permanent hearing loss.

cancer

Malignancy, known as carcinoma, is usually associated with several factors and can generate factor stability.
