Govt Law. Professor. Wojciech Maksymowicz: I appeal to the conscience of PiS delegates

On Thursday, the PiS delegation submitted to Sejm a draft of a new Govt Act, which, among other things, would introduce solutions to help employees test SARS-CoV-2 for free, as well as request information from employers about the negative outcome of such a test.

He announced that he was not going to support the PiS bill in its current form. He added that the remaining members of the Polish 2050 circle did not agree with the terms proposed in the draft. – This law is going in the wrong direction. Before voting on this bill, I urge the consciences of PiS MPs, doctors and nurses who have reactions like mine, because they are being used as a tool to support a plan that does more harm than good – Maksymowicz said.

In accordance with the PiS draft, employers and employees working under civil law contracts may be required to provide information that may indicate a negative result of the SARS-CoV-2 diagnostic test. “The need to introduce such solutions is commanded by the need to popularize the effectiveness of diagnostic tests as an effective tool to prevent the spread of SARS-CoV-2 virus” – the justification pointed out.

The draft also assumes that an employee who has not undergone a diagnostic test will continue to work with the employer under existing rules. For this reason, he will not be assigned to work outside of his permanent workplace or to perform other types of work, but in circumstances provided for in the draft law, he will have to pay compensation for the infection.
