Worten and Modelo Continente fined €515,000 for selling radio equipment without complying with the law — DNOTICIAS.PT

The national telecommunications regulator Anacom announced today that it has imposed fines amounting to €515,000 on Modelo Continente and Worten for selling radio equipment that does not comply with legal requirements.

“Anacom imposed fines on the companies Modelo Continente and Worten totaling more than half a million euros (€515,000) for the sale of radio equipment that did not comply with legal requirements. In both cases additional loss penalties were also applied to the state for the non-compliant equipment,” says the authority. Regulatory in a statement issued today.

The document issued today provides for the imposition of a single fine of €291,250 on Worten and advisory penalties for the loss of 34 models of radio equipment to the state.

In the case of Modelo Continente, the fine amounted to 223,700 euros, and 21 radio models were confiscated to the state.

It is related to the marketing of equipment due to the failure of the manufacturer, the failure of the importer, and the failure of the distributor.

According to Anacom, failures by the manufacturer included lack of information such as model name, lot number, serial number or other identifying elements, manufacturer's name, indication of a connection point, lack of instructions or information in Portuguese, or no For frequency bands, transmitted radio frequency energy or European Union (EU) declarations of conformity.

In this sense, the regulatory body adds that after the requests, neither the full technical documentation nor the copies of the EU declarations of conformity were made available.

“There was also the sale, as a distributor, of 19 radio models, in the case of Worten, 27 in the case of Modelo Continente”, which did not contain the CE marking, instructions and safety information in Portuguese, model name, lot number, serial number or other identifying elements or importer's name.

Anacom says the lack of this type of information “penalizes consumers for a number of reasons.”

The Regulatory Authority considers that the lack of documentation or identification may harm the proper use of the equipment, make it difficult to monitor compliance of the equipment with applicable standards regarding health protection and electromagnetic compatibility, and make communication impossible if the products are defective or do not comply with the safety levels used in Europe.
